What is At Will Employment?

South Carolina is an at-will employment state. That means that employees can quit their job at any time and for any reason at all. Similarly, employers can hire or fire workers for any reason.

However, an employer cannot fire you if it violates the terms of a contractual agreement or if it goes against public policy.

Minimum Wage and Overtime in South Carolina

Minimum wage is $7.25 an hour in the state of South Carolina. Tipped workers, such as bartenders, must be paid $2.13 an hour.

To be paid minimum wage as a tipped worker, you must receive at least the equivalent of minimum wage in tips. If your tips plus wages do not equal minimum wage, your employer must pay the difference.

Overtime pay will cover any hours worked that exceed 40 hours a week. Employees that work overtime must be paid time and a half, unless your job meets one of a few exemptions to the overtime rules.

If you work weekends or holidays, you will not necessarily be paid for overtime. Overtime rates will only apply if those extra hours exceed the 40 hour a week limit.

What Kind of Damages Can I Receive in My Wage and Hours Lawsuit?

Unpaid Wages

You will be compensated for any wages your employee did not pay including overtime. If your employer paid you regular wages for overtime pay, you will be compensated for the difference.


In some instances, you may also be paid interest for the amount you were not paid. The state will determine the interest rates owed by your employee.

In other cases, you may be paid “liquidated damages.” This is a preset amount paid instead of interest.

If your employer acted willfully, which is to say he or she underpaid you and knew they were breaking the law, liquidated damages may be set by the state for twice your unpaid wages.


Some states may also require employers to pay a penalty. This may be awarded to account for waiting time, the amount of time the employee had to wait for their pay. The waiting penalty will usually equal a certain number of days of unpaid wages.

Your employer will also have to cover any legal fees the employee incurred in pursuing the case.
