Bank of America received over $336 billion dollars from the federal government during the real estate and financial crisis in 2008. In exchange, Bank of America agreed, in writing, to implement the Home Affordable Modification Program (HAMP) in March of 2009 to assist millions of American homeowners facing foreclosure. Bank of America specifically agreed to use “reasonable efforts” to effectuate modifications of mortgage loans that so qualified. Bank of America failed to follow through on its written promises and obligations.
The federal government, through the Department of Justice, sued Bank of America in U.S. v. Bank of America, N.A., et al., Case Number 1:11-cv-03270 (E.D.N.Y.) in which a settlement provided that Bank of America pay back the government $1 billion and to “pay $7 billion in relief to struggling homeowners, borrowers and communities affected by the bank’s conduct”.
A class action lawsuit was also filed on behalf of all affected borrowers. The court ultimately ruled, however, that these suits were too individualized and therefore more appropriately brought as individual actions rather than as a class action.
